since last year june 08 i join city square clarkhatch . at first i very happy to join this fitness center. util i felt this fitness center i felt very sad .. because always i go there water heater no hot water , steam so dirty , sawna got time period .and the time i complain and complain to them .. they never improve themself . i started give up in dec 08.but the time i paid instalment RM126 per month , total RM1365.

so i almost 6 month did not join it ..suddenly i found my credit card statement charge a new amont from clarkhatch. and the amount not instalment ..

i went to there . asking them about this .. they told me , i already sign up since i join clarkhatch , and i already agree. oh ! the time i talking with one lady boss ,she agree refund the money to me.. but almost 3 week the lady boss did not call me,, let me dissapointed..louzy serivce..

i shock , because the time the guy ask me to join clarkhatch , did not tell me , the credit card will charge for next year ,if u did not terminate your member, and if you want terminate have to 1 month notice.why ! clarkhatch never call for asking member willing want to join for next year ??and simply charge ? international fitness center ? using agreement to suck fitness member ..

Hi Nick

I just checked my contract and their is a section where you can sign to have it automatically taken out each year. I never signed that part and therefore assume no money will be taken out.

I can only assume you signed without reading the small print.

But I'm sure they will refund you.

Not had any problems at all this week, so fingers crossed things are improving.

Please accept my apologies I was told this morning about 4 people also auto charged and they want refunds.(hear say from another member)

I am really surprised big company like Clark hatch would do this as they open themselves up to be sued, for breach of contract and fraud. Providing as I say the box giving them permission to auto renew was not signed.

Any way keep us informed nick, how you get on.

because the fatty malay told me within 3 month !
we 3 decide make complaint to bank negara or one of goverment department settle we and clarkhatch( at menara Ansar 17th floor)

p.s the fatty malay girl was lier ., playing hide and seek only .

I was just saying id be surprised if they did not refund and 3 months is to long anyway they can just refund to your card there and then if they said 3 months then agree they taking the piss.

A solicitors letters advising them to refund immediately or face legal action for cost and compensation. (should do the trick) cost about rm50.

Also I would suspect the fact its been done to more than one person,(hearsay) could constitute fraud and the police could be involved, (what they are doing is nothing more than stealing your money).And again the key to all this is providing you did not sign the part to allow them to auto renew then you would win your case.

Below is part of a letter i got from the management of clarke hatch jb on the 28th oct - what a joke if you are having those problems. But maybe you should address your concerns to the below owners.(they may not even know of this problem of the auto renew.)

yesterday we already decide goto menara Ansar 17th , to settle this problem ..
we have prepare . complain letter, credit card statement ,clarkhatech agreement , ic ,all each 3 copies . submit to this department ..
after submit ,we gonna bring one copy to clarkhatch and let them chop our copy .

so now wating 1.12.09 9.00am . we will there menara ansar to mini court.

i knew that this coming 12.11.09 got one member will go there also.

by the way . the YY was knew my problem ,the time i told her , why i six month did not come , because this because that. i though understanding person, but she is good actress .. and she love playing hide and seek ..
